GENERAL CONDITIONS OF USE

ARTICLE 1. PURPOSE OF THE GENERAL CONDITIONS OF USE

TREND MEDIA, a simplified joint stock company with capital of 1000 euros, for which the head office is located at 23 cours Edouard Vaillant, 33300 Bordeaux, registered at the Bordeaux company and commercial register under number 820 702 926, publishes and operates the present Internet site (https://my.geo-tag.fr) (hereafter the "Site").

The present General Conditions of Use (hereafter the "GCU") are intended to define the conditions for the use of the Site.

The Site enables any user, being an adult natural person not acting within the context of his/her professional activity (hereafter the "User"), to geo-locate a natural person addressee (hereafter the "Addressee") by using the geolocation service offered by TREND MEDIA (hereafter the "Geolocation Service"). The Addressee must have accepted the request for geolocation (hereafter the "Request") by clicking on the hypertext link to the GCU of the Site, which is inserted in the SMS (hereafter the "SMS") and accepting them after having read them.

By continuing his/her browsing on the Site, the User fully and unreservedly accepts the present GCU.

The version currently online of the GCU is the sole version that is binding upon the User during the entire period of use of the Site, until a new version replaces it.

ARTICLE 2. ACCESS TO AND USE OF THE SITE

Access to and use of the Site are reserved for strictly personal use. The User warrants that all of the information communicated is true and up to date. The User undertakes not to use the Site and the information or data shown on it for commercial, political or advertising purposes or for any form of commercial solicitation.

TREND MEDIA endeavours to provide content that is as accurate as possible on the Site. However, the elements composing the content of the Site are provided as an approximation and are not comprehensive, subject to any modifications that may have been made since they were put online. TREND MEDIA may, at its discretion, and at any time, modify the content of its Site.

The Site enables Users to give an order, providing that they have first created and validated a personal online account (hereafter the "Personal Account").

The Request is subject, in addition to the GCU, to the General Conditions of Sale (GCS) of TREND MEDIA, which are also accessible on the site and which must be expressly accepted by the User before validation of his/her order.

ARTICLE 3. CONTENT OF THE SITE

All of the brands, photographs, texts, comments, illustrations, images (animated or not), video sequences and sounds, as well as all the IT applications that may be used in the functioning of the Site and, more generally, all elements reproduced or used on the Site, are protected by the intellectual property laws in force. They are the full and entire property of TREND MEDIA or its partners.

Any reproduction, depiction, use or adaptation, in any form whatsoever, of all or part of these elements, including the IT applications, for purposes other than personal and private use for non-commercial purposes, without the prior and written agreement of TREND MEDIA or the partners concerned, is strictly prohibited. The fact that TREND MEDIA might not undertake proceedings as soon as it becomes aware of this unauthorised use does not mean that such use is accepted and that legal action will not be taken.

ARTICLE 4. MANAGEMENT OF THE SITE

For the proper management of the Site, TREND MEDIA may at any time:

• suspend, interrupt or limit access to all or part of the Site or reserve access to the Site, or certain parts of the Site, to a given category of Internet users;
• delete all information that could disrupt functioning or contravene applicable laws;
• suspend the Site in order to install updates.

ARTICLE 5. PERSONAL DATA

In accordance with the law n°78-17 (French data protection act) dated 6 January 1978, personal data relative to Users and Addressees may be subject to automated processing by TREND MEDIA.

The processing of this data was the subject of a normal declaration to the French data-protection authority (CNIL) registered under number "2144466 v 0".

This personal data is used by TREND MEDIA to enable it to process orders and manage relationships with its customers, as well as for commercial, statistical and marketing purposes.

The personal data collected when giving an Order is essential to its processing by TREND MEDIA. Without it, the Order will not be able to be validated.

Any User or Addressee may object to the disclosure of his/her data or exercise a right to access, rectify or delete this data, under the conditions specified by the law n°78-17 (French data protection act) dated 6 January 1978 by sending their requests to TREND MEDIA by email at support@trend-media.zendesk.com or by letter to TREND MEDIA – 23 cours Edouard Vaillant, 33300 Bordeaux

The personal data may be communicated by TREND MEDIA to third parties (commercial partners, service-providers or other member companies of the TREND MEDIA Group) located in France, for the requirements of execution of Orders or for commercial purposes.

If the User or the Addressee does not want his/her personal data transmitted to third parties for commercial purposes, he/she should indicate this to TREND MEDIA by email at support@trend-media.zendesk.com.

TREND MEDIA may also collect your browsing data using data-collection tools installed on the Site.

ARTICLE 6. HYPERTEXT LINKS

TREND MEDIA provides the User with hypertext links whose activation may direct him/her towards sites or external sources over which TREND MEDIA has no control of the content.

Consequently, the Internet sites of third parties, their content and all information accessible from these hypertext links published on the Site or in documents that may be downloaded from the Site remain the exclusive responsibility of their authors and TREND MEDIA expressly rejects all responsibility in this regard.

The User is not authorised to create a hypertext link towards the Site, a page on the Site and/or a file on the Site without the prior and written agreement of TREND MEDIA.

ARTICLE 7. LIABILITY

The liability of TREND MEDIA may not be implicated in case of failure, breakdown, difficulty or interruption in functioning, preventing access to the Site or any of its functionalities.

The equipment for connecting to the Site used by the User is under his/her entire responsibility. The User must take all appropriate measures to protect his/her equipment and his/her own data, particularly from virus attacks via the Internet. The User is also solely responsible for the sites and data that he/she consults.

TREND MEDIA may not be held responsible in case of legal action against the User:

• due to the use of the Site or any service accessible over the Internet;
• due to non-compliance by him/her with the present GCU.

TREND MEDIA is not responsible for any damage caused to the User, to third parties and/or to his/her equipment due to his/her connection to or use of the Site and he/she waives any action against it in this regard.

If TREND MEDIA is the subject of a mutual agreement procedure or a legal procedure due to the use of the Site by the User, TREND MEDIA may take action against the User to obtain compensation for any harm, financial loss, sentences and expenses which may arise from this procedure.

ARTICLE 8. COMPLAINTS

In case of any complaints, the Customer may contact the customer service department of TREND MEDIA on support@trend-media.zendesk.com or by letter at TREND MEDIA, 23 cours Edouard Vaillant, 33300 Bordeaux.

ARTICLE 9. APPLICABLE LAW

The present GCU are governed by French law and subject to the competence of the French courts, subject to specific assignment of jurisdiction arising from a particular law or regulation.
